Rules and measures to prevent emergencies caused by the burning of stubble, vegetation, plant debris and waste

In view of the alarming increase in the number of uncontrolled vegetation fires within Mureş County, which have resulted in significant damage, we would like to draw attention to the importance of complying with the relevant legislation governing this activity:

- Târgu-Mureş Municipal Council Decision No. 302 of 30 September 2021 on updating measures relating to good management, maintaining cleanliness, compliance with hygiene standards and the beautification of Târgu-Mureş Municipality stipulates in Chapter I, Article 6, paragraph (2):

“The burning of any waste within the municipality is prohibited.”

- Government Emergency Ordinance 92/2021 on waste management, as subsequently amended and supplemented, provides:

Article 20(3)
– The abandonment, discarding and concealment of waste are prohibited

para. (5) – It is prohibited to set fire to any type of waste and/or substance or object.
para. (6) – The burial of waste of any kind is prohibited

Art. 62
para. (1) The following acts constitute an offence and are punishable as follows: (b) by a fine of between 30,000 and 45,000 lei for natural persons and between 50,000 and 70,000 lei for legal persons, in the event of a breach of the provisions of Article 20(3)-(6)

Article 66
(1) The following acts constitute offences and are punishable by imprisonment of between 1 and 5 years or by a fine where the quantity or the impact on the environment or on the life, physical integrity or health of persons cannot be disregarded:

(e) setting fire to any type of waste and/or substance or object:
(f) burying waste:
(g) disposing of waste outside authorised areas;’’
(h) abandoning, discarding and/or concealing waste:

- Government Emergency Ordinance No. 195/2005 on environmental protection, as subsequently amended and supplemented, provides:

Art. 94
(1) Environmental
protection is an obligation of all natural and legal persons, for which purpose: (n) they shall not burn stubble, peat, forest litter, reeds, scrub or grassy vegetation;

Art. 96(3) The
following
constitute administrative offences and are punishable by a fine of between 7,500 lei (RON) and 15,000 lei (RON) for natural persons, and between 50,000 lei (RON) and 100,000 lei (RON) for legal persons, the following legal provisions: Point 16. The obligation of landowners and landholders, whether titled or not, not to burn and to prevent the burning of stubble, peat bogs, forest litter, reeds, scrub or grassy vegetation.”
